Trademarks are an essential asset for almost every business. In Myanmar, Registering your trademark will provide you with an exclusive right to your mark for 10 years following registration, which can be renewed every 10 years. We handle all aspects of trademark practice, such as trademark search, filing, and registration, licensing, franchising, anti-counterfeiting, trademark enforcement, and litigation in Myanmar.

The basic requirements of trademark filing and registration are as below:

  • Name of the Applicant;
  • The Applicant’s passport number or If the applicant is a Company- Company’s registration number and type of company ;
  • Address of the Applicant;
  • Specimens of the mark in high solution in jpg format;
  • The International lists of goods/ services of the mark;
  • POA (TM 2 Form) to be notarized by Notary Public in the applicant’s country; and

Official Fee for each class.

Industrial Design Services

Industrial Design

In Myanmar, you may apply to register your industrial design at anytime if it has never been published. If your design has been published, you must submit an application for registration within six months.

The basic requirements of Industrial design filing are as below:

  1. Name, address, contact details, passport number or the company’s registration number, and type of legal entity of the applicant;
  2. Name, nationality, and address of the creator;
  3. Locarno classification of the industrial design;
  4. POA (ID 2 Form) need to be notarized by the Notary Public in the Applicant’s country;
  5. Drawings, graphics, or photographs representing the industrial design;
  6. Short description of industrial design;
  7. Employment contract or agreement if the creator is an employee; and
  8. Official Fee for each class.

Thus, the patent filings are available in Myanmar as of October 31, 2024 under the New Patent Law 2019.

Mr. Tin Win (Attorney)

Mr. Tin Win is a licensed Advocate of the Supreme Court in Myanmar. He practices in civil and criminal litigation, commercial litigation, dispute resolution, land, labor, and intellectual property issues.

He holds a Bachelor's Degree in law (LL.B.) from Yangon University and has also completed the Diploma in Business Law, Diploma in International Law, Diploma in Philosophy, Diploma in English from Yangon University and DL-101 (WIPO) courses.

Mr. Tin Win is a qualified Advocate with over 50 years of experience in criminal and civil litigation, including nine years as a public prosecutor at the Myanmar Court. He has extensive knowledge of Myanmar law and has represented clients in several civil and criminal litigations. He handles a variety of legal matters, such as trademark infringement, breach of contract, debt collection, land rights, inheritance, employment, customary law, contract disputes, and other criminal and civil lawsuits.

Ms. May Thazin Aung is a Lawyer who hold the Higher Grade Pleader license and also a licensed trademark & Industrial design agent in Myanmar. 

She holds Master of Arts (Business Law) and Diploma in Business Law from Yangon University as well as Bachelor degrees of Law from Mandalay Yadanarbon University.  She also holds a certificate DL-101 and DL 303 (WIPO).

She completed an internship at the local law firm and worked as an apprentice lawyer there for four years, giving her experience in client representation, and legal practice in criminal and civil cases. She also has a various professional background, having worked for three and a half years at a leading foreign law firm with offices in Myanmar and Cambodia, handling corporate and intellectual property matters for the Myanmar office and intellectual property matters for the Cambodia office.
